บทคัดย่อ
          บทความวิชาการนี้มีวัตถุประสงค์เพื่อนำเสนอพัฒนาการโครงสร้างขององค์กรตำรวจไทยช่วง พ.ศ. 2535 - 2564 โดยใช้รูปแบบวิธีวิทยาเชิงคุณภาพในการวิจัยเอกสารระดับทุติยภูมิและกฎหมายที่เกี่ยวข้อง ผลการวิจัยพบว่า องค์กรตำรวจของไทยมีพัฒนาการโครงสร้างการบริหารองค์กร จำนวน 4 ช่วงสำคัญ ได้แก่ ช่วงที่ 1 การปรับโครงสร้างการบริหารองค์กรตำรวจ พ.ศ. 2535 – 2544 ด้านการบริหารงานภายในโดยลดลำดับชั้นการบังคับบัญชาขององค์กรตำรวจนครบาล และการแบ่งอำนาจการบริหารจากส่วนกลางสู่ส่วนภูมิภาค รวมถึงการตราพระราชกฤษฎีกาโอนกรมตำรวจ กระทรวงมหาดไทย ไปจัดตั้งสำนักงานตำรวจแห่งชาติ พ.ศ. 2541 ตั้งแต่วันที่ 17 ตุลาคม 2541 โดยอาศัยความตามมาตรา 221 และมาตรา 230 วรรคสอง ของรัฐธรรมนูญแห่งราชอาณาจักรไทย ช่วงที่ 2 การปรับปรุงโครงสร้างของสำนักงานตำรวจแห่งชาติ พ.ศ. 2544 - 2549 โดยการตราพระราชบัญญัติระเบียบการบริหารแผ่นดิน ฉบับที่ 5 พ.ศ.2545 และปรับปรุงพระราชบัญญัติปรับปรุงกระทรวง ทบวง กรม พ.ศ. 2545 โดยเนื้อความในมาตรา 46(7) มีผลให้สำนักงานตำรวจแห่งชาติ มีฐานะเป็นกรมอยู่ในบังคับบัญชาของนายกรัฐมนตรี ต่อมารัฐบาลได้ตราพระราชบัญญัติตำรวจแห่งชาติ พ.ศ. 2547 ซึ่งกำหนดระบบการบริหารองค์กรในทุก ๆ มิติ ถือเป็นการเปลี่ยนแปลงในระดับมหภาค ช่วงที่ 3 การปฏิรูปสำนักงานตำรวจแห่งชาติ พ.ศ. 2549 - พ.ศ. 2551 ในประเด็นการปฏิรูปสำนักงานตำรวจแห่งชาติให้ขึ้นตรงต่อกระทรวงยุติธรรม และการจัดตั้งคณะกรรมการพิจารณาเรื่องราวร้องทุกข์เกี่ยวกับตำรวจเป็นหน่วยงานอิสระไม่ประสบผลสำเร็จอย่างไรก็ตามใน พ.ศ. 2552 รัฐบาลได้ปรับปรุงโครงสร้างการบริหารภายในโดยจัดแบ่งหน่วยงานระดับกองบัญชาการออกเป็น 30 กองบัญชาการ และหน่วยงานระดับกองบังคับการเป็น 6 กองบังคับการ ขึ้นตรงกับสำนักงานตำรวจแห่งชาติ และจัดแบ่งกลุ่มภารกิจให้มีความชัดเจนยิ่งขึ้น ช่วงที่ 4 การปรับปรุงโครงสร้างของสำนักงานตำรวจแห่งชาติ ตั้งแต่วันที่ 22 พฤษภาคม พ.ศ. 2557 – ปัจจุบัน รัฐบาลกำลังปฏิรูปโครงสร้างการบริหารองค์กรตำรวจไทยผ่านการจัดตั้งคณะกรรมการฯ ชุดต่าง ๆ มาศึกษาการปฏิรูปองค์กรตำรวจ และร่างกฎหมายขึ้นมาหลายฉบับและอยู่ในระหว่างการพิจารณาร่างกฎหมายตำรวจแห่งชาติฉบับใหม่ ซึ่งการบริหารองค์กรตำรวจไทยในปัจจุบันยังเป็นไปตามพระราชบัญญัติตำรวจแห่งชาติ พ.ศ. 2547

          บทความนี้เป็นส่วนหนึ่งของดุษฎีนิพนธ์ เรื่อง การพัฒนาโครงสร้างการบริหารองค์กรตำรวจของไทย ซึ่งเป็นการศึกษาตามหลักสูตรปรัชญาดุษฎีบัณฑิต สาขาวิชาการบริหารกระบวนการยุติธรรม คณะนิติศาสตร์ มหาวิทยาลัยธรรมศาสตร์ ปีการศึกษา 2564 โดยมี ศ.ดร.อุดม รัฐอมฤต เป็นอาจารย์ที่ปรึกษา

Abstract

           Academic article was aimed to present “Development of the Administrative Structure of the Royal Thai Police” from 1992 to 2021. The qualitative methodology is used to research secondary documents and related laws. The results revealed that The Thai Royal Police has developed its organizational structure in 4 key periods: Period 1: Restructuring of the administration of the police organization in 1992 - 2001. The internal administration had a reduction in the hierarchy of command of the Metropolitan Police organization, and the division of power from central to regional. Including the enactment of Royal Decree on the Transfer of the Police Department Ministry of Interior to establish the Royal Thai Police in 1998 on October 17, 1998 by virtue of Section 221 and Section 230 paragraph two of the Constitution of the Kingdom of Thailand. Period 2: Restructuring of the Royal Thai Police, 2001-2006 by enacting the Administrative Regulations Act (No. 5), B.E. Section 46 (7) results in the Royal Thai Police Has a position as a department under the command of the Prime Minister. Subsequently, the government enacted the National Police Act of 2004 which stipulates the system of organizational administration in all dimensions, a macro change. Period 3: Reform of the Royal Thai Police, 2006 - 2008. During this period, there is an issue of reforming the Royal Thai Police to directly refer to the Ministry of Justice and the establishment of a committee to consider complaints about the police to be an independent agency is not successful. However, in 2009, the government has revised the internal administrative structure by dividing the command-level departments into 30 headquarters and 6 command-level units to be directly related to the Royal Thai Police and categorize the missions to be clearer. Period 4: Restructuring of the Royal Thai Police (Present) From May 22, 2014 - December 2021, the government is reforming the structure of the administration of the Thai Royal Police through the establishment of various committees to study the reform of the police organization. Moreover, government are drafting several laws, and considering a new national police law. The current administration of the Thai Royal Police is still in accordance with the National Police Act B.E. 2547.
